Statutory regulations on the modification of machinery
On 9 April 2015 the German Ministry for Employment and Social Affairs published an interpretation paper on the subject of "Substantial modification to machinery". The so-called Machinery Directive regulates the statutory requirements across Europe. Its national implementation in German law takes the form of the Machine Ordinance (9th Ordinance on Product Safety). While the Product Safety Act was implemented explicitly for Germany, the requirements it contains are very much applicable for other European countries insofar as they concern "substantial modification to machinery".
What constitutes a "substantial modification"?
You can now determine whether the modifications to your machine constitute a "substantial modification" as defined in this paper using the PASmsi app. Just answer the predefined questions, and you will then get a detailed description for further action every step of the way. You will also find out whether a new conformity assessment procedure needs to be carried out under the current Machinery Directive.
